§ 1 Scope and contracting parties
These General Terms and Conditions apply to the use of the services offered at www.teachpie.de and app.teachpie.de accessible platform “TeachPie”. The contracting party is Astep Ahead UG (haftungsbeschränkt), the platform operator.
Any deviating or supplementary terms of the user become part of the contract only if the provider expressly agrees to them. Individual agreements take precedence over these General Terms and Conditions.
§ 2 Scope of services
TeachPie is a digital education platform for teaching, learning, and organizational processes. Depending on the plan, role, and enabled features, it may provide features for lesson planning, material creation, learning support, analytics, organizational management, Marketplace use, and AI-powered assistance in particular.
The specific scope of services is determined by the offer booked in each case, the features enabled in the product, and any additional individual agreements.
§ 3 Registration, access and user account
3.1 Registration
A user account is required to use essential platform features. You can register by email and password or using the available single sign-on methods.
3.2 Obligation to provide accurate information
Users are required to provide complete and accurate information and keep their data up to date.
3.3 Access security
Login credentials must be kept confidential. Users must take appropriate measures to prevent unauthorized access and report any suspected misuse without delay.
3.4 One account per person
As a rule, each person may have only one personal account, unless institutional use or organizational requirements call for otherwise.
3.5 Minors
For individual accounts, the legal requirements for minors and any required consent apply. For school use, the schools or school authorities responsible are accountable for ensuring the legal arrangements are in place.
§ 4 User groups, roles, and institutional use
TeachPie is designed in particular for teachers, learners, schools and school authorities. A user’s specific role determines which features and data access are available.
When used by an institution, the school or school authority may be the controller within the meaning of data protection law. In these cases, TeachPie processes data in accordance with the contractual agreements and instructions in place.
§ 5 Use of Artificial Intelligence
5.1 Nature of the AI features
TeachPie uses artificial intelligence to support teaching, learning and organizational processes. AI results are intended to assist and prepare, not to make autonomous final decisions.
5.2 No binding subject-specific or legal advice
AI-generated content is provided solely as support. They do not constitute binding educational, professional, medical, psychological or legal advice.
5.3 User responsibility
Users are required to critically review AI-generated results before using them. For pedagogical, organizational and assessment-related decisions, ultimate responsibility remains with the people making those decisions, particularly teachers and responsible bodies.
5.4 Examinations and assessment
AI-supported analysis or preliminary marking features are not intended to provide automatic final assessments. Final assessments and any resulting decisions must not be based solely on AI output.
5.5 Transparency and regulatory classification
The provider aligns its AI features with applicable transparency, documentation, and oversight requirements, taking into account in particular the GDPR and EU AI Act. However, the specific regulatory classification depends on the particular use case.
§ 6 Rules of use and prohibited use
The platform may only be used within the legally permissible and contractually agreed scope. In particular, the following is prohibited:
- use for unlawful, discriminatory, offensive, or content harmful to minors,
- attempting to bypass safeguards or access restrictions,
- misuse of AI features, particularly for impermissible surveillance, manipulation or assessment purposes,
- the entry or processing of personal data to an extent that is not necessary for the relevant purpose,
- automated, unauthorized bulk use or scraping.
§ 7 User-Generated Content and Marketplace
7.1 Rights to content
Users retain the rights to content they create themselves, unless mandatory law or separate agreements provide otherwise.
7.2 Required Usage Rights
To the extent necessary to provide the platform, users grant the provider a simple, non-exclusive right to use the content by storing, processing and displaying it, and making it accessible as part of the relevant feature.
7.3 Marketplace
The Marketplace terms displayed in each case also apply to published Marketplace content. The provider is entitled to block or remove content in the event of violations of the law, these Terms and Conditions, or third-party rights.
7.4 Responsibility for content
Users are responsible for ensuring that content they upload does not infringe the rights of third parties and may be used lawfully.
§ 8 Prices, subscriptions and payment
Where TeachPie offers paid services, the prices, service descriptions, and billing intervals communicated at the time the contract is concluded apply.
Payments are processed using the payment methods offered in each case. For recurring subscriptions, the renewal and cancellation rules provided at the time of purchase apply.
§ 9 Term, Termination, and Account Deletion
The term of paid services depends on the plan purchased. Users can close their account or terminate their contract within the agreed term and notice periods.
The provider may terminate contracts for good cause or suspend accounts if users seriously violate these Terms and Conditions, applicable law, or security interests.
§ 10 Availability, changes and further development
TeachPie is provided as a digital service that is continuously developed. Uninterrupted or error-free availability at all times cannot be guaranteed.
The provider is entitled to further develop or adapt features, user interfaces, technical foundations and external service providers, provided that users’ legitimate interests are duly taken into account and essential contractual obligations are not removed.
§ 11 Rights to the platform
All rights to the platform, its brands, designs, data structures, texts, technical concepts, and other protected components remain with the provider or the respective rights holders. Users are granted only the non-transferable right of use required for use in accordance with the contract.
§ 12 Data protection and data processing
The processing of personal data is governed by the current Privacy Policy and, in the case of institutional use, where applicable, by supplementary data processing and organizational agreements.
Current subprocessors and key technical service providers are documented in a separate vendor and subprocessor list, which can be updated independently of the other legal texts.
Schools and school authorities must still review their own legal bases, information obligations and, where applicable, any additional protective measures for their specific use case.
§ 13 Warranty for digital services
The statutory warranty rights apply where applicable. For digital services, please note that TeachPie is a dynamic service that is continuously adapted and developed.
§ 14 Liability
The provider is liable without limitation in cases of intent and gross negligence, and for injury to life, body or health. In cases of ordinary negligence, the provider is liable only for breach of material contractual obligations and is limited to damage that is foreseeable and typical for the contract.
There is no liability for results that are purely AI-generated as such; users remain responsible for reviewing and using them responsibly.
§ 15 Indemnification
Users shall indemnify the provider against third-party claims arising from unlawful or contract-breaching use of the platform or from unlawful user content, insofar as the user is responsible for the cause.
§ 16 Consumer protection and right of withdrawal
Where users are consumers within the meaning of the law and enter into a paid distance contract, statutory consumer rights, including any rights of withdrawal, apply. The information provided when the contract is concluded is authoritative.
§ 17 Special Provisions for Schools and School Authorities
Institutional contracts may be subject to additional or different contractual terms, service descriptions, data protection agreements and governance provisions. In the event of a conflict, these take precedence over the general provisions of these Terms and Conditions.
§ 18 Changes to these Terms and Conditions
The provider may amend these Terms and Conditions with effect for the future where there is a legitimate reason to do so, for example due to changes in the law, technological advances, new features, or organizational adjustments. Any changes will be communicated to affected users in an appropriate manner.
§ 19 Final provisions
The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods, insofar as this is not precluded by mandatory consumer protection provisions. If any individual provisions are or become invalid, the validity of the remaining provisions remains unaffected.
§ 20 Dispute resolution
The European Commission provides a platform for online dispute resolution. However, the provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board, unless required by law.
